with university law professors and the legal
speaker for the Austrian Socialist Party
Dr. Johannes Jarolim, legal
speaker for the Social Socialist Party was strongly
of the opinion that the use of 278a against
the 10 animal protectionists was incorrect according
to the legislative body.
Dr. Petra Velten, Department
of Penology, University of Linz, explained in
detail why she sees the use of 278a in this
case as a punishment for holding an opinion.
She also made the point that on these same grounds,
football clubs must therefore be prosecuted
under 278a as soon as football fans go outside
the law.
Dr. Bernd-Christian Funk,
Department of Constitutional and Administrative
Law, University of Vienna, saw no reason why
both 278 and 278a could not be got rid of without
replacements.
Following on from the expert panel's
contributions there was a lively question and
answer session. The event was well attended
and there was a strong consensus that this trial
does not conform to legal norms laid out by
the constitution.
